If the State Department did act contrary to the recommendation of CPAC, the department would be obligated under the Convention on Cultural Property Implementation Act to explain to Congress its decision to act independent of that committee's advice. Since the Bureau of Educational and Cultural Affairs has steadfastly refused to release any information regarding CPAC deliberations, it is impossible for the general public to know how CPAC has advised on the Chinese request.
